Terms and conditions

We appreciate you considering a Regional Escapes property. Our team will do everything they can to make your stay comfortable and memorable.

We ask that every guest read and understand our booking terms summarized below. A breach of these terms may lead to the cancellation of your booking before or during your stay.



1. Definitions and Interpretation


1.1 Definitions

  • Agent means Regional Escapes Pty Ltd (ACN 651 579 574) or Great Ocean Retreats Pty Ltd (ACN 115 619 559) or both (as the case may be).
  • Agreement means the holiday accommodation agreement between You, Us, and the Property Owner, constituted by these Terms and Conditions and any other written terms applicable to the accommodation which are agreed between the parties prior to the commencement of the Stay.
  • Booking means an accepted booking following the completion of the Verification Process and Our receipt of the Initial Prepayment from You.
  • Business Day means a day that is not a Saturday, Sunday, public holiday, or bank holiday in Melbourne, Victoria.
  • Claim means a claim, action, proceeding, judgment, or demand made or brought by or against a person, however arising and whether present, unascertained, future, or contingent.
  • Conditions means these holiday accommodation terms and conditions.
  • Consumer Guarantees means the guarantees set out in Division 1, Part 3-2 of the Australian Consumer Law.
  • Initial Prepayment means the first prepayment of 25% of the Price payable upon a Booking, as specified in the Property Details.
  • Liability or Loss means any liability, loss, cost, expense, damage, charge, penalty, outgoing, or payment, however arising and whether present, unascertained, future, or contingent.
  • Price means the price payable for the Property, calculated on a nightly basis.
  • Property means the property the subject of the Booking.
  • Property Details means the details pertaining to the Property as shown on Our website or communicated to You orally or in writing.
  • Property Owner means the owner of the Property You Book for Your Stay.
  • Rent means the rent collected by the Agent in respect of the Property.
  • Stay means the period of the Booking.
  • Verification Process means the process directed by Us in verifying Your identity and such information we require from You for the purposes of confirming the booking of Your intended Stay for the Property.
  • We, Us, or Our means the Agent.
  • You or Your means the person making the Booking.

1.2 Interpretation

  • The singular includes the plural and vice versa.
  • The words “in writing” include any communication sent by post or email.
  • The word “person” includes a natural person and any body or entity whether incorporated or not.
  • A mention of anything after include, includes, or including, does not limit what else might be included.
  • A reference to all or any part of a statute, rule, regulation, or ordinance includes that statute as amended, consolidated, reenacted, or replaced from time to time.
  • A reference to a group of persons or things is a reference to any two or more of them jointly and to each of them separately.
  • An agreement, representation, warranty, or indemnity by two or more persons binds them jointly and each of them separately.
  • No provision of this agreement will be construed to the disadvantage of a party merely because that party was responsible for the preparation of the agreement or the inclusion of the provision in the agreement.
  • All monetary amounts are in Australian dollars, unless otherwise stated, and a reference to payment means payment in Australian dollars.

2. General


  • You acknowledge and agree that:
    • You are 18 years of age or over.
    • These Terms and Conditions form part of the Agreement between You, Us, and the Property Owner.
    • The Agent is the agent for the Property Owner and may exercise all of the rights of the Property Owner, on the Property Owner’s behalf, under this Agreement.
    • By completing the Verification Process and paying the Initial Prepayment, You are bound by the Agreement, including these Terms and Conditions.

3. Services


3.1 Accommodation

We facilitate the booking of holiday accommodation of Property under our management. By booking the Property, You will be entering into an agreement with the Property Owner to occupy the Property subject to these Terms and Conditions.


3.2 Ancillary Services

We may arrange ancillary services in connection with Your Stay, which include:

  • Hire of adventure gear and equipment for entertainment.
  • Pre-packaged food and drinks and/or gift hampers on arrival.
  • Arranging transport.
  • Facilitating wellness retreats.
  • Arranging dining at local restaurants.
  • Arranging access to local golf clubs.
  • Arranging itineraries, which include the bundling of the above services with the holiday accommodation.

You acknowledge and agree that We may engage third parties to provide the Ancillary Services, in which case:

  • the third party bookings are subject to the terms and conditions specified by the third party providers
  • The Property Owner and We are not responsible for any errors or amendments made by third party providers; and
  • The Property Owner and We are not liable for any act or omission, default, or negligence of third party providers.

4. Bookings


  • Should You wish to book the Property, You must complete the Verification Process and pay the Initial Prepayment.
  • The completion of the Verification Process and payment of the Initial Prepayment constitutes an offer by You to book the Property for Your intended Stay, which can be accepted or rejected by Us within 5 Business Days.
  • If We reject Your offer, We will return the Initial Prepayment to You within 5 Business Days, subject to bank processing timeframes.
  • If We accept Your offer, We will confirm the Booking with You in writing within 5 Business Days.

5. Price


  • The balance of the Price is payable 28 days prior to the commencement of the Stay.
  • Without limiting the generality of clause 5.1, You will not be permitted to check in without making payment of the balance of the Price in full.

6. Cancellation Policy


  • This cancellation policy is subject to the policy of third-party holiday accommodation platforms. If this cancellation policy contradicts the third-party policy, the third-party policy prevails.
  • If You cancel Your Booking within 24 hours, You will receive a full refund of monies paid.
  • After 24 hours of Your Booking, the below conditions apply:
    • We may cancel Your Booking at any time more than 30 days prior to the Stay without cause. If We cancel without cause, We will refund You the Initial Prepayment in full.
    • We may cancel Your Booking if You fail to pay the balance of the Price in accordance with clause 5.2. In this case, 25% of the Price will be charged to You.
    • If You cancel more than 28 days prior to the Stay, We will provide a refund of all monies paid.
    • If You cancel within 28 days prior to the commencement of the Stay, no refund will be provided.
    • Any cancellation requests made after 24 hours of check-in will incur 100% of the price charged to You.
  • Any refunds provided under this clause will incur a 10% administration fee on the amount collected.

7. Accommodation Licence


  • You acknowledge that Your accommodation at the Property is a mere contractual licence to occupy the Property during the Stay and is subject to Our ability to terminate this licence immediately upon any breach of these terms.
  • A breach by any person of the licence conditions during the Stay is deemed to be a breach by You.

8. Use of Property


  • During the Stay, You must:
    • Comply with any by-laws applicable to the Property.
    • Notify Us of any damage to the Property or its contents as soon as practicable.
    • Permit Us access to the Property for inspection upon provision of 2 hours’ notice.
  • During the Stay, You must not:
    • Engage in illegal activity at or around the Property.
    • Engage in anti-social activity on or around the Property.
    • Create excessive noise on or around the Property.
    • Hold events or functions at the Property without prior permission.
    • Permit more guests than allowed as stated on the Property details.
    • Bring any caravans onto the Property.
    • Smoke inside the Property unless otherwise stated.
    • Allow pets unless the Property is marked pet-friendly.

9. Indemnity


  • You indemnify the Property Owner, the Agent, and their representatives against any Claims or Liability arising from Your breach of this Agreement or Your conduct during the Stay.

10. Check In and Check Out


  • You may check in as per the Booking on the first day of the Stay and must check out on the last day.
  • Before Check Out, You must:
    • Clean the Property, including any BBQ or animal waste.
    • Wash all dishes or start the dishwasher.
    • Secure all windows and doors.

11. Damages and Missing Items


  • You must report any breakages or damages to Us.
  • No items are to be removed from the Property.

12. Additional Charges


  • We may charge You reasonable additional amounts following the conclusion of Your Stay in relation to:
    • Any damage to the Property or its contents caused by You or Your invitees.
    • Any failure to clean the Property as required under clause 10.2.
    • The loss of any keys, access passes, or garage remotes.
    • Any costs reasonably incurred by the Agent in connection with Your Stay, including an administrative staff cost of $100 per hour.
  • Any extra cleaning required will be charged at a per-hour rate with public holiday and weekend surcharges applicable.
  • If there are any charges applicable after Your Stay, we will notify you of the charges and provide photographic evidence for your reference.

13. Schoolies Bookings


  • Schoolies Bookings or any booking made by guests under 25 years old:
    • Require a security deposit of $1,000.00 or $100.00 per person (whichever is greater), payable by electronic funds transfer prior to Check In and released within 14 days after Check Out.
    • Have a 3-car limit for cars parked on the Property during the Stay.
  • You will not be permitted to check in until the Security Deposit has been paid.

14. Risk


  • Subject to the operation of the Consumer Guarantees, You acknowledge and agree that Your occupation of the Property (and that of any of Your invitees) is at Your sole risk. Specifically:
    • The Property Owner and We are not liable for any breakdown of electrical appliances during the Stay.
    • The Property Owner and We are not liable for any loss suffered as a result of failure of power, gas, or other services connected to the Property.
    • The Property Owner and We are not responsible for any personal injury suffered by You or Your invitees at the Property.
    • The Property Owner and We are not responsible for any damage to, or theft of, Your property during or after Your Stay.
    • You are responsible for any damage caused by You or Your invitees to the Property or its contents.
    • You are responsible for any personal injury suffered by any person as a result of Your conduct during the Stay.
  • Refunds or compensation will not be considered once You are staying at the Property or after vacating the Property if it does not meet guest expectations.

15. Complaints


  • If there are any issues upon arrival or during Your Stay, please contact Us via the booking channel for assistance.
  • You must provide photographic evidence if you wish to claim reimbursement for any issues reported.
  • We will use reasonable endeavours to rectify any issues promptly to ensure an enjoyable stay.

16. Excluded Terms


  • To the maximum extent permitted by law and excluding the Consumer Guarantees, all terms, conditions, and warranties that would be implied into this Agreement or in connection with the supply of the accommodation services under law, statute, custom, or international convention are excluded.

17. Limitation of Liability


  • Except in the case of a breach of the Consumer Guarantees, Our liability to You for any loss or damage suffered in contract, tort, or otherwise is limited to the refund of the Price or the re-supply of replacement accommodation services.

18. Privacy Disclosure and Consent


  • You authorise Us to collect and store Your personal information in accordance with Our privacy policy located on Our website and amended from time to time.
  • You consent to Us using Your personal information to add You to Our marketing list and send information or offers relating to Our services.

19. Changes to the Terms and Conditions


  • We reserve the right to amend the Terms and Conditions from time to time.
  • Please check this page periodically to review any changes made, as they are binding on You.

20. General


  • This Agreement shall be governed by the laws of Victoria, and the parties submit to the non-exclusive jurisdiction of the courts operating in that state.
  • You warrant that this Agreement creates binding and valid legal obligations.
  • You must not assign this Agreement to any other party without the Agent’s written consent, which may be withheld at its absolute discretion.
  • You warrant that You have read and understood this Agreement and have had an opportunity to obtain legal advice before executing it.
